General conditions of use of the Website
These General Conditions shall apply both to the information exchanged and to all the services offered on the Web, so that they will govern at all times the conditions of navigation on the Web. It is understood that access or the mere use of www.gaudistone.com implies acceptance of the general conditions that GAUDÍ STONE has published at all times.
1. Personal Data Protection Policy
1.1. In application of the provisions of Law 15/1999, of December 13, 1999, on the Protection of Personal Data, GAUDÍ STONE informs Users that all personal data, or not, that the User provides by virtue of the navigation process or their commercial relations with GAUDÍ STONE, will be incorporated into a file for automated processing, maintained under the responsibility of MEDITERRANEAN GAUDISTONE S.L., with registered office at Urb. Monte Pichells, 4 – 12598 Peñíscola (Castellón), with CIF: B-10882900, registered in the Mercantile Registry of Castellón, who is responsible for the file.
1.2. The purpose of this file will be the management of the relationship between GAUDÍ STONE and the Users, obtaining information that allows GAUDÍ STONE to adjust its marketing criteria to the preferences of the Users, carrying out market research, adapting our products to the preferences or needs of the Users, and allowing a personalized navigation, being able to perform studies and segmentation of personal and commercial information, as well as carrying out promotional and advertising activities in relation to the services provided by GAUDÍ STONE or by third parties through any means of advertising and information that, in the opinion of GAUDÍ STONE, may be of interest to Users, including sending messages through any system including SMS, UTMS.
1.3. This file is owned by GAUDÍ STONE, is declared its existence in the Data Protection Agency, under the name User Registration and is pending assignment of order number.
1.4. The User expressly accepts the inclusion of the data collected while browsing the Web, or those provided through the completion of any form, as well as those derived from the commercial relationship and/or delivery of the products in the automated file indicated above. During the data collection process and in each space of the Web in which these data are requested, the User will be informed by means of a hyperlink or by means of the form itself, of the obligatory nature or not of the collection of such data.
1.5. GAUDÍ STONE informs Users of their right to exercise, with respect to the data collected, the rights recognized in the Organic Law 15/1999, and in particular the rights of access, rectification or cancellation of data and opposition when it is relevant, as well as the revocation of consent for the transfer of their data or for any of the uses indicated above. The rights referred to in the preceding paragraph may be exercised by each User by sending a cancellation request to the e-mail address info@gaudistone.com.
1.6. GAUDÍ STONE informs Users that in order to access some of the contents or services of the Web, it may be necessary to fill in registration forms in which the User is requested to enter personal data. Likewise, it is possible that GAUDÍ STONE, in order to improve its services, activates “cookies” programs through which User data is obtained.
1.7. GAUDÍ STONE undertakes to use the data included in the aforementioned automated file respecting their confidentiality and to use them for the purpose of the file, as well as to comply with its obligation to safeguard them and adopt the necessary measures to avoid their alteration, loss, treatment or unauthorized access, in accordance with the provisions of the Regulation on Security Measures for automated files containing personal data, approved by R.D. 994/1999, of July 11.
2. Intellectual and Industrial Property Prohibition of hyperlinks
2.1. All content displayed on the Web and especially the designs, text, graphics, logos, icons, buttons, software, trade names, trademarks, industrial designs or any other signs susceptible of industrial and commercial use, are subject to intellectual and industrial property rights of GAUDÍ STONE or third party owners who have duly authorized their inclusion on the Web.
2.2. Under no circumstances shall it be understood that by means of the User’s access and navigation, any license is granted or any waiver, transmission, total or partial transfer of said rights is made, nor is any right or expectation of right conferred, and in particular, of alteration, exploitation, reproduction, distribution or public communication of said contents without the prior express authorization of GAUDÍ STONE or of the corresponding owners of said rights.
2.3. No link may be established to the Website from any other website without the express prior consent of GAUDÍ STONE.
3. Responsibility of GAUDÍ STONE
3.1. GAUDÍ STONE shall only be liable for damages that the User may suffer as a result of the Use of the Website when these are attributable to a fraudulent act of the company. The User acknowledges and accepts that the use of the Web, is done under its entire responsibility and risk.
3.2. GAUDÍ STONE is not responsible, by way of example but not limited to, for any damages that may arise from:
a) Inferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operation of the computer system or in the computer equipment of the Users, caused by reasons beyond the control of GAUDÍ STONE, which make impossible or delay the provision of the services.
b) Delays or blockages in the use caused by deficiencies or overloads in the network or in other computer systems.
c) The actions of third parties by means of illegitimate intromissions in the Web.
d) The impossibility of providing due service or access to the network to the User for reasons not attributable to GAUDÍ STONE, but to third parties or force majeure.
e) GAUDÍ STONE does not guarantee that Users use the Web in accordance with the law, these general conditions, morality and generally accepted good customs and public order, nor that they do so in a diligent and prudent manner GAUDÍ STONE is not responsible for the misuse that Users may make of the contents of its website, being the sole responsibility of those who access it.
4. Obligations of the User:
4.1. The User agrees to comply with these general conditions, as well as to comply with the special warnings or instructions for use contained therein or on the Web, to act in accordance with the law, custom and the requirements of good faith, using appropriate diligence and refraining from using the Web in a way that prevents, damages or impairs the normal operation of the same, the property or rights of GAUDÍ STONE, its suppliers, other Users or any third party.
4.2. The User undertakes, in the use of the Web, as well as in the use of the services to:
a) In the event of registration, the User undertakes to provide truthful information and to keep it updated.
b) Not to introduce, store or disseminate on or from the Web, information or material that is defamatory, libelous, obscene, threatening, xenophobic, incites violence or discrimination based on race, sex, ideology, religion, or that in any way violates morality, public order, fundamental rights, public liberties, honor, privacy or the image of third parties.
c) Not to introduce, store or disseminate in or from the Web any computer program, virus, data, hardware or telecommunications equipment or any other electronic or physical device capable of causing damage to the Web, in any of the services offered through this or in any of the equipment, systems or networks of GAUDÍ STONE, of any User, of the suppliers of GAUDÍ STONE or in general of third parties, or that by any other means or form is capable of causing them any type of alteration or prevent the normal operation of the same.
d) To diligently guard the “User name” and “password” provided by GAUDÍ STONE, as identifying and enabling elements for access to the services of the Web, agreeing not to transfer its use or to allow access by third parties to them, assuming responsibility for any damages that may be caused by their misuse. The User undertakes to notify GAUDÍ STONE of its loss or theft, as soon as possible, as well as any risk of access to its “User name” or “password” by any third party.
e) Not to carry out advertising, promotional or commercial exploitation activities through the Web, not using the contents and in particular the information obtained through the Web to send advertising, messages for direct marketing purposes or for any other commercial purpose, or to collect or store data of third parties.
f) Not to use false identities, nor to impersonate the identity of others in the use of the Web or in the use of the services of the same one, including, in its case, the use of passwords or keys of access of third parties.
g) Not to destroy, alter, use for use, disable or damage the data, information, programs or electronic documents of GAUDÍ STONE, its suppliers or third parties.
h) Not to introduce, store or disseminate through the Web any content that may infringe the intellectual or industrial property rights or business secrets of third parties, or any content of which it does not have the right to make it available to third parties.
5. Communications
5.1. For any communication between GAUDÍ STONE and the User, the User must contact the customer service department by e-mail to the address info@gaudistone.com or by written communication addressed to the customer service department of GAUDÍ STONE: Urb. Monte Pichells, 4 –
12598 Peñíscola (Castellón).
5.2. GAUDÍ STONE communications to the User will be made in accordance with the data provided by the User when registering on the Website.
5.3. The User expressly accepts the use of e-mail as a valid procedure for all communications related to the use of the Web for the forwarding of such communications.
